SPI Pharma recently issued a press release statement regarding Roquette Frères pending suit against SPI Pharma in Federal District Court in Delaware for infringement of Roquette’s U.S. Patent No. 5,573,777.
The Patent covers mannitols with physical and functional properties as claimed in the Patent as well as the process of spray dry manufacturing of such products.
Although the SPI press release correctly identified Mannogem™ EZ as an infringing product, SPI's press release failed to note that SPI’s Pharmaburst™ B1, B2 and C1 products and Advantol XT1™ also are accused in the lawsuit as products infringing Roquette’s Patent.
